Equitable Services Overview
Sections 1117 and 8501, Elementary and Secondary Education Act (ESEA), as amended by the Every Student Succeeds Act (ESSA), require participating local educational agencies (LEAs), in consultation with appropriate private school officials, to provide eligible children attending non-profit private schools, their teachers, and their families with services or other benefits that are equitable to those provided to eligible public school children, their teachers, and their families.
Timely and meaningful consultation with appropriate private school officials is an essential requirement in an LEA’s implementation of an effective program for eligible private school children, their teachers, and their families. Consultation involves discussions between public and private school officials on key topics that affect the ability of eligible private school students to participate equitably in applicable programs. Effective consultation provides a genuine opportunity for all parties to express their views and to have those views considered and has the goal of reaching an agreement between the LEAs and eligible private schools on how to provide equitable and effective programs for eligible private school children, teachers, and families.
